Dear Mr. Bopp,

I am writing with reference to Wayne Kirk, who ran for office in Marion County and was fined $1000 for late or missing campaign finance reports. I represented Mr. Kirk without success before the Marion County Election Board. I explained that under the 1997 revision of the election code, a person who does not raise or spend $100 is not subject to fines under the act. So far the board has not taken action to collect the $1000 fine, but could still do so. I encouraged Mr. Kirk to contact your office. Apparently you spoke with him by phone, but he hasn't followed up further.

You have a better track record than I do with such matters, and I believe that Mr. Kirk would be better off being represented by your firm than for me to try to handle the case. For health reasons, I generally stopped taking new cases about 5 years ago, and am in the middle of moving out of state.

My concern is not so much with Mr. Kirk individually, as it is with the way the IEC is acting outside of its authority in a way that chills political participation. I had filed a couple of lawsuits on this issue previously, but had not done much more with them, and they were dismissed for failure to prosecute.

The legal point at issue is whether IC 3-....
